Justice James Kolawole Omotosho of the Federal High Court in Abuja has scheduled May 8 for judgment in the legal battle between MultiChoice Nigeria Limited and the Federal Competition and Consumer Protection Commission (FCCPC).
The judge set the date on Thursday after hearing arguments from both parties and adopting their written submissions. The case stems from MultiChoice’s lawsuit seeking judicial intervention following the FCCPC’s objection to price increases on its DStv and GOtv services.
Earlier, the court had issued an interim order preventing the Commission from taking administrative actions against MultiChoice over the price adjustments. The company had argued that the FCCPC’s planned sanctions threatened its business operations and violated its rights.
During Thursday’s proceedings, the court granted the Commission an extension of time to regularize its processes while allowing MultiChoice to withdraw an application for an interlocutory injunction, which had become unnecessary.
MultiChoice’s lead counsel, Moyosore Onigbanjo (SAN), contended that the key issue in the case was whether the FCCPC had the authority to control the pricing of the company’s services. While acknowledging the regulator’s oversight role, he argued that the FCCPC Act does not empower the Commission to fix prices or prevent service providers from adjusting their rates.
