The Supreme Court has overturned the rulings of both the Court of Appeal and the Federal High Court, which had previously removed Senator Samuel Anyanwu as the National Secretary of the People’s Democratic Party (PDP).
Delivering the lead judgment on Friday, Justice Jamilu Tukur, speaking on behalf of a five-member panel, ruled that the question of who holds the position of National Secretary within the PDP falls under the party’s internal affairs and is not subject to judicial intervention.
As a result, the Supreme Court struck out the October 2023 judgment of the trial court and set aside the majority decision of the Court of Appeal, which had in December upheld Anyanwu’s removal. Instead, the apex court affirmed the minority judgment of Justice Ekanem, who had previously nullified the trial court’s ruling due to lack of jurisdiction.
The Supreme Court also, held that the plaintiff, Aniagu Emmanuel, lacked the legal standing to file the suit, as he failed to demonstrate how the appointment of the PDP’s National Secretary personally affected him.
