Abby Zwerner, 26, received an email stating that her contract with Newport News Public Schools was being terminated, leading to speculation about the reasons behind her dismissal. Zwerner’s lawyers argue that her firing is directly related to her $40 million lawsuit against NNPS and some of its administrators.

In response to the shooting, Zwerner filed a $40 million lawsuit against the Newport News School Board, former Superintendent Dr. George Parker, former Richneck Principal Briana Foster-Newton, and former Richneck Assistant Principal Dr. Ebony Parker.

Breit argues that his client’s firing is an attempt to exert pressure on her due to the ongoing lawsuit, noting that Zwerner has not received payment since February. He also alleges that the school tried to force her to take workers’ compensation, but when she refused, they stopped paying her.

The incident that led to Zwerner’s termination occurred on January 6 at Richneck Elementary School in Newport News, Virginia. Her six-year-old student shot her in the classroom, causing severe injuries. The police investigation revealed that the gun belonged to the student’s mother, Deja Taylor, who is now facing federal charges related to the incident.
