The Court of Appeal in Abuja has ordered a fresh hearing in the legal dispute over the Kano Emirate involving Alhaji Nasir Ado Bayero.

The Appellate Court ruled on Friday that Bayero was denied a fair hearing due to the inadequate manner in which the Kano High Court handled the case.

Justice Mohammed Mustapha, who delivered the lead judgment, stated that the Kano High Court was unfair to Bayero by proceeding with the case without serving him a hearing notice, which would have allowed him to present his defence.

Justice Mustapha emphasized that all courts are required to provide equal opportunities for all parties involved, noting that the handling of Bayero’s case amounted to a denial of justice.

The Court of Appeal found that Bayero should have been notified of the proceedings so that he could raise his objections before judgment was delivered in what was described as a flawed process.

As a result, the Court ordered that the case be sent back to the Chief Judge of the Kano State High Court, with instructions to assign it to a new judge for a prompt and fair resolution.

The Court did not award any costs against the respondents in the appeal filed by Alhaji Ado Bayero in the Kano Emirate tussle.
