Court dismisses Sen Jimoh Ibrahim’s litigation challenging Aiyedatiwa as Ondo APC guber candidate

Justice Inyang Edem Ekwo of the Federal High Court in Abuja has dismissed a lawsuit filed by Senator Jimoh Ibrahim against Ondo State Governor Lucky Aiyedatiwa’s qualification as the All Progressives Congress’ (APC) candidate for governor of Ondo State.

The lawsuit, which primarily contested the way the primary election that produced Aiyedatiwa for the upcoming gubernatorial election was conducted, was dismissed after the Senator abruptly withdrew it.

Justice Ekwo had given the APC, Aiyedatiwa, and the Independent National Electoral Commission (INEC) until Tuesday, May 14, to submit their responses to the lawsuit that sought to have Aiyedatiwa removed from the APC’s candidatures for governor in November 2024.

However, Mike Uche, Ibrahim’s attorney, told the court during the proceedings on Wednesday that his client had decided to drop the lawsuit.

He informed Justice Ekwo that the defendants had previously received the necessary service of the withdrawal notice, which was filed on May 28 but dated May 27.

The solicitors for each of the defendants attested to receiving the notice of withdrawal and had no objections.

Because the parties had already gotten into disagreements with one another prior to the withdrawal, Justice Ekwo dismissed the lawsuit in its entirety.
